Egskeidingsmediasie / Divorce Mediation

Egskeidingsmediasie is die proses waarvolgens 'n huwelik of verbintenis op 'n nie-vyandige wyse ontbind word. Dit kan plaasvind vóór, tydens of nadat die partye uitmekaar gaan.
Dit is 'n vrywillige proses waarin die mediator disputende egpare help om 'n wedersyds aanvaarbare oplossing vir hul konflik te bereik.
Egskeidingsmediasie kan 'n meer tegemoetkomende alternatief bied aan partye wat uitmekaargaan of skei en wat nie elkeen hul eie prokureur wil aanstel wat in hulle belang beding nie. Dit voorkom ook 'n uitgerekte, vyandige en duur regsgeding.
Die onderwerpe wat hanteer word, sluit in
  • Sorg van en die primêre woonplek van minderjarige kinders
  • Kontak met die minderjarige kinders
  • 'n Ouerskapplan
  • Onderhoud/finansiële ondersteuning
  • Verdeling van bates
  • Finansiële (rehabilittatiewe) onderhoud van gade
'n Ooreenkoms om te bemiddel word by aanvangs deur albei partye onderteken.
Die partye besluit oor die geskilpunte wat bespreek sal word en die agenda vir elke sessie.
Die siening en wense van die kind(ers) word ook in 'n kinderonderhoud gehoor.
Die partye se besluite oor hul ouerskapsreëlings, eiendom en finansies word saamgevat in 'n geskrewe Memorandum van Verstandhouding - dit vorm die basis vir 'n regsdokument.
Die partye word aangemoedig om hul prokureurs die Memorandum van Verstandhouding te laat nagaan om te verseker dat dit ondubbelsinnig is, dat dit wetlik solied is, dat al die geskilpunte aangespreek is en dat hulle die gevolge van hul besluite verstaan.
Die partye word genooi om na mediasie terug te keer indien daar verdere probleme ontstaan.
Die hoofdoel van hierdie tipe mediasie is om die partye te leer hoe om in die toekoms soortgelyke geskille by te lê in die beste belang van hulle kinders.
Divorce Mediation is the process of dissolving a marriage or union in a non-adversarial way. It could take place before, while or after the parties have separated.
It is a voluntary process in which the mediator helps disputing spouses to arrive at a mutually acceptable solution to their conflict.
Divorce mediation can provide a more courteous alternative to separating or divorcing parties who do not wish to hire their own attorneys to negotiate on their behalf and who wish to avoid a hostile, lengthy and costly legal battle.
The subject matter dealt with includes
  • Care and primary residence of minor children
  • Contact with minor children
  • A parenting plan
  • Maintenance/financial support
  • Division of assets
  • Spousal (rehabilitative) maintenance
An agreement to mediate is signed by both parties at the outset.
The issues to discuss and the agenda for each session are agreed to by both parties.
The views and wishes of the child(ren) are also heard in a child interview.
The parties' decisions regarding parenting arrangements, property and finances will be summarised in a written agreement, the Memorandum of Understanding - the basis for a final legal document.
Parties are encouraged to have their attorney(s) review the Memorandum of Understanding to be sure it is not ambiguous, is legally sound, that all the issues have been addressed and that the parties understand the consequences of their decisions.
Parties are invited to return to mediation if any problems arise in the future.
The most important aim with mediation is to teach the parties how to solve similar differences in future so that all decisions are made in the best interest of their children.

DIE OUERSKAPPLAN / THE PARENTING PLAN

Indien u minderjarige kinders het, sal ek u help om saam 'n Ouerskapsplan uit te werk.
Ek sal u ook aanmoedig om kinders ouer as 4 jaar vir 'n kinderonderhoud te bring. Dit gee hulle die geleentheid om ook hulle gevoelens en wense in 'n veilige, onpartydige omgewing te laat hoor, soos wat die wet vereis.
Besluite wat in die ouerskapplan vervat word sluit in:

Voogdyskap
Albei biologiese ouers het voogdyskap. Die wet vereis geskrewe toestemming van albei biologiese ouers ten opsigte van:
  • Aansoek om paspoorte vir die kind/ers
  • Huwelik van 'n kind onder die ouderdom van 18 jaar
  • Koop en verkoop van nie-roerende eiendom
  • Aangaan van kontrakte
  • Litigasie in die hof
  • Verwydering van die kind/ers uit die RSA

     

Dood van ouer/ouers

 

Opgedateerde testament

 

Hersiening van die ouerskapplan.
Die ouerskapsplan word hersien wanneer:
  • Die ouers se omstandighede verander
  • Wanneer die kinders se behoeftes en omstandighede verander
  • As 'n ouer verhuis
  • As een van die partye hertrou
  • As 'n nuwe baba gebore word
  • Ná 'n gesinskrisis of dood
Should you have minor children I will assist you in drawing up a Parenting Plan.
I will encourage you to let your children over the age of 4 years attend a child interview with me. This gives them the opportunity to also voice their feelings and wishes in a safe, impartial environment as is required by law.
Decisions included in the parenting plan involve the following:
 
Where and with whom the children live
 
Parental responsibilities and rights
 
Contact of both parents with the children
  • When each parent will see the children
  • The children's programs / school timetables
  • Transport of the children
  • Week days, Weekends, Sleepovers
  • Birthdays of the children at home / at school

  • Father's Day / Mother's Day
  • Family gatherings
  • Contact with the other parent between visits via telephone, Skype, face time, SMS, etc

     

Care and education of the children
  • Education
  • Medical and dental care
  • The emotional and psychological wellbeing of your children
  • Religion, culture and traditions.
  • Discipline, house rules and boundaries
  • New life partners of the parents
  • Care and association
  • Relocation of one parent
  • All decisions regarding the children

     

Financial maintenance of their children
The pro rata maintenance responsibility is calculated according to
  • the income of each party
  • the budget of each party
  • the budget for the children
  • the need of each party
  • the capacity of each party to contribute

Guardianship
Both biological parents have guardianship. The law requires the written permission of both biological parents regarding:
  • Application for passports for the child/ren
  • The marriage of a child under the age of 18 years
  • Encumbrance/alienation of immovable property
  • Signing of contracts
  • Litigation in court
  • Removal of the child/ren from the RSA

Revision of the Parenting Plan
The parenting plan is revised when:
  • The circumstances of the parents change
  • When the needs and the circumstances of the children change
  • One of the parents relocates
  • One of the parents remarries
  • A new baby is born
  • After a family crisis or death

TARIEF / TARIFF

'n Mediasiesessie duur gewoonlik 1½ uur en die volledige mediasieproses kan tussen 2 tot 7 sessies duur, afhangende van die partye se agendas en deelname.
U ontvang na afloop van elke sessie 'n notule van die besluite wat geneem is.
Die kinderonderhoud duur ongeveer 40 minute.
A mediation session normally lasts for 1½ hour and the mediation process could take between 2 and 7 sessions depending on the agendas of the parties and their participation.
You will receive minutes after each session recording all decisions that were taken.
The child interview takes approximately 40 minutes.
